RGB vs CMYK&/h2&&p&&b&没有光线就没有色彩。&/b&而在自然界中，我们一共可以看到两种类型的光线。&/p&&p&第一种是物体自身发出光线，比如灯泡、显示器、电视等等。中学的时候我们学过三棱镜的实验。自然界中的白光并不是单色光，用棱镜色散之后会看到组成白光的多种色光。&/p&&p&白色光线是由这些五彩光线相加形成的。所以这些&b&自发光的物体，对应的是加色模型&/b&&/p&&figure&&img src=&https://pic4.zhimg.com/v2-f202cd85f3_b.jpg& data-rawwidth=&800& data-rawheight=&600& class=&origin_image zh-lightbox-thumb& width=&800& data-original=&https://pic4.zhimg.com/v2-f202cd85f3_r.jpg&&&/figure&&p&第二种是物体反射的光线，比如颜料、涂料、印刷品等等。&/p&&p&这些物体吸收了一部分光线，而反射剩下的一些光线，从而显示出不同的色彩。因此这些&b&反射出来的颜色，则对应了减色模型。&/b&&/p&&figure&&img data-original=&https://pic4.zhimg.com/v2-92dbf94b17ab03d1a66f_r.jpg&&&/figure&&p&无论是哪种色彩模型，首先我们都要定义一个概念，叫做“原色”。&b&原色，是不能通过其他颜色，混合而得出的“基本色”。&/b&&/p&&p&&b&在加色模型中，一共有红（R）、绿（G）、蓝（B）三原色。&/b&而红绿蓝三原色两两混合，可以形成黄、青、品三种二次色。继续混合，则能调出各种各样的色彩。&/p&&figure&&img data-original=&https://pic4.zhimg.com/v2-ab16ae611bb52aaa88f7b_r.jpg&&&/figure&&p&可以想象上面一张照片，是一个黑色的显示器。首先我在显示器上显示一个红色圆形，然后再在显示器上显示一个蓝色圆形，你会发现红、蓝重合的地方，混合形成了品红色。&/p&&p&如果我再显示一个绿色圆圈。你会看到红绿混合形成黄色，绿蓝混合形成青色。而红绿蓝全部重合的地方，则发出了纯白色光。&/p&&p&与加色模型不同，在&b&减色模型中，三原色变成了青（C）、品（M）、黄（Y）。&/b&&/p&&figure&&img data-original=&https://pic2.zhimg.com/v2-1cb00fef0cd_r.jpg&&&/figure&&p&&br&&/p&&p&我们可以想象上面一张图是一张白纸。首先我们用黄色颜料画一个圆，再用青色颜料画一个圆，你会看到黄青混合出了绿色。&/p&&p&如果我们再用品红色颜料画个圆，就可以看到黄品混合而成的红色，以及青品混合而成的蓝色。而青品黄全部混合在一起，则变成了黑色。&/p&&p&在大规模打印中，青品黄颜料混合成的黑色并不够纯黑，而且成本太高。因此印刷机还有专门的黑色（K）墨水。CMYK中的最后一个K，就是指的这个黑色。&/p&&p&&br&&/p&&h2&2 互补色与相邻色&/h2&&p&无论是RGB，还是CMY，虽然他们的原色不同。但是色彩之间的混合关系却是相同的，比如绿色和红色，混合出来的都是黄色。&/p&&p&我们把RGBCMY一起画在下面的照片中，可以发现一些有趣的色彩关系。（下面这张图非常重要，最好能熟练记住。）&/p&&figure&&img data-original=&https://pic3.zhimg.com/v2-f29da0e4aa97e_r.jpg&&&/figure&&p&&b&我们把一种颜色相邻的两种颜色，叫做的他的相邻色。&/b&如上图所示，青色的相邻色，是绿色和蓝色。绿色的相邻色，是黄色和青色。&/p&&p&&b&而一种颜色对面的颜色，叫做他的互补色。&/b&比如红色的互补色是青色，绿色的互补色是品色。&/p&&p&相邻色和互补色，是我们调色的一个重要依据。&/p&&p&&b&我们要增加一种颜色，一共有两种方式：一是增加他的相邻色，二是减少他的互补色。&/b&&/p&&p&比如我们要增加红色，既可以同时增加他的相邻色黄色和品色，也可以减少他的互补色青色。我们可以使用Photoshop里的可选颜色工具：&/p&&figure&&img data-original=&https://pic4.zhimg.com/v2-52a6eb1bce090b_r.jpg&&&/figure&&p&那么问题来了，如何用色温色调滑块让照片偏红、偏青呢？&/p&&p&很简单，红色的相邻色是黄色和品色。所以色温色调同时右移，加黄加品，也就是加红。&/p&&p&青色和相邻色是蓝色和绿色，把色温色调滑块一起左移，就可以让照片偏青啦。&/p&&p&理解了RGBCMY的相邻色、互补色关系，很多复杂的调色问题都迎刃而解。&/p&&p&比如下面一个S型的红色通道曲线，高光加红，阴影减红。因此调出来的照片，高光偏红，阴影偏青（红色互补色）。&/p&&figure&&img HSL色彩空间&/h2&&p&RGB模型对人类而言并不直观，比如我说一种颜色是由60%红，30%绿和90%蓝组成的，你应该很难想象出来，这到底是哪种颜色？&/p&&p&因此人们设计出了HSL色彩空间，来更加直观的表达颜色。HSL是色相（Hue）、饱和度（Saturation）和亮度（Lightness）这三个颜色属性的简称。&/p&&p&&b&色相（Hue）是色彩的基本属性，就是人们平常所说的颜色名称，如紫色、青色、品红等等。我们可以在一个圆环上表示出所有的色相。&/b&&/p&&figure&&img &p&当你看到被抄袭/盗图时，首先截图对方文章，当然截图很容易被称为伪造的，且很难被公证，所以你要准备另外一台手机，录像下来侵权者的侵权文章，你要从手机桌面开始，点击微信，进入对方公众号，尤其当对方公众号账号ID显示出来后，停顿几秒，然后点击进入公众号，点击【查看历史消息】，打开被侵权推送，从上至下缓慢移动，直到文章结束，然后选择【在浏览器打开】，拍摄下侵权链接。&/p&
&p&这么做的目的是为了让证据更有说服性，虽然这种证据不敢说完美，但足以用来通知侵权人。&/p&
&br&&p&我为什么没说去公证，因为在实践方面，此类事件90%以上以和解结束，侵权方聘请律师的费用都够赔偿你的了，公证必要性不大，能手握有效证据即可。&/p&&br&&p&&strong&2.&/strong&&strong&找人陈述不扯淡&/strong&&/p&&br&&p&为什么我说要找人呢，因为【投诉】在微信里几乎是个摆设，明显的抄袭微信有时候也会视而不见，不要指望官方能帮你，天助自助者，自己动手，丰衣足食。找什么人，当然是&strong&负责人&/strong&，抄袭类公众号大多是隶属于一个公司，当然也不乏个人号进行抄袭，我们分开说应该如何操作。&/p&
&p&&strong&公司号：&/strong&&/p&
&p&如果是公司号抄袭，此时你应该双管齐下，其一是在对方微信后台留言，但作用不大，因为编辑为了逃避责任一般会选择无视，（当然不乏有良心的编辑），其二是点开公众号后，打开资料页，有可能可以看到一个负责人的电话，那么恭喜你，你获得了电话号码，假如没有，你可以进入公众号，下方的可选择项一般会有一个类似【合作】或者【联系我们】的选项，里面一般会有相应地联系人电话，这个电话基本上都属于可以管事的人，如果没有电话只有邮箱，还是省省，邮箱的回复效率十分低下。&/p&
&p&假如还是没有电话，怎么办，你可以期待编辑看到留言给你回话，或者用万能的朋友圈或者百度去找这个公众号所属公司的工作人员，相信我，你一定会找到的，假如真的没有找到。&/p&
&p&点击账号主体，找到工商执照注册号，然后百度【工商局】，打开工商局的网站，有一个，国家企业信用信息公示系统，输入工商执照注册号，你可以查询到这个公司的营业地址，直接登门协商把。&/p&
&p&&strong&个人号：&/strong&&/p&
&p&留言就行了，或者用一切办法，朋友圈，贴吧等等，找到他本人。&/p&&br&&p&&strong&3.&/strong&&strong&删除赔偿加道歉&/strong&&/p&&br&&p&好，接下来是如何协商，不打无准备之仗，协商前，请准备好：&/p&
&p&&strong&《著作权法》第四十七条，你的请求，你的原创作品。&/strong&&/p&
&p&我建议你打电话，因为声音的压迫会让对方重视这件事，之后你们基本上是微信在沟通，沟通时对方基本上会派一个编辑和你沟通，他也基本上会讲一些很扯蛋，很法盲的句子，例如：&/p&
&p&“世界已经很美好了。”&/p&
&p&“用一用也没什么啊”&/p&&p&“用你的怎么了！”&/p&&p&“我觉得好就用了。”&/p&&br&&p&&strong&甚至有一种套路是：&/strong&&/p&
&br&&p&&strong&免费要授权&/strong&，无论是事前授权还是事后授权，他会声称“共赢”“合作”，我们的粉丝团队非常强大，或者，我们具有无穷潜力，现在只是公益，凭兴趣在做，以后会帮助你的。&/p&
&br&&p&你可能会被这类花言巧语所蒙蔽，但是请注意，&/p&
&br&&p&这种公众号，往往在&strong&成为利益既得者后过河拆桥&/strong&。&/p&
&br&&p&身边的例子：&/p&

&p&关于第三步中的这三点都是有《著作权法》第47条做理论依据的，也就是说：你可以让对方删除侵权推送或者图片，不要再继续传播下去，也可以让对方公开发布赔礼道歉的相关内容，给你恢复名誉，如果对方举不出合法的授权，还可以让对方赔偿损失。&/p&
&p&这三种方式你可以进行部分选择，比如你是个土豪你可以放弃赔偿，也可以全部选择，比如我是个穷比，我就又要赔偿又要道歉。&/p&
&p&只要你选择了，对方就得履行，&strong&否则，视为协商失败。&/strong&&/p&
&p&我建议你可以请求：&/p&
&p&&strong&同等平台，同等位置进行道歉并恢复名誉，要求赔偿和你的作品相符的金额。&/strong&&/p&
&br&&p&一般而言，赔偿的计算标准是你的&strong&实际损失&/strong&，你可以暂时理解为就是你的“稿费”，至于数量，如果你是一般的摄影师，你可以在200-400/张内进行选择，具有一定身价或照片拍摄不易，可以请求更多，某摄影作品在判决中获得了15000元/张的赔偿[1]；如果你是一般写作者，你可以在0.5-2元/字内进行选择，文章写作不易可以请求更多，新京报声称的赔偿标准是5元/字[2]，&strong&这里仅做参考&/strong&，第三部分会有本操作的法律详解。&/p&
&p&这里有一个小插曲，就是jpg文件可否作为原始摄影文件，一般而言，raw文件才属于原始摄影文件，但在实践中，使用手机拍摄时可能没有raw格式，使用相机拍摄时未开启raw格式，那是不是就不能维权了？不是的，假如你有足够多的间接证据证明是你拍摄的，那么也是可以被支持的。&/p&
&p&恩，记得只陈述客观事实，不扯淡。&/p&&br&&p&你这样做的结局无非两个：&/p&
&br&&p&&strong&i.&/strong&&strong&对方继续耍无赖，&/strong&&/p&
&p&&strong&ii.&/strong&&strong&对方认性不认量&/strong&&/p&
&p&继续分情况讨论，如果继续耍无赖，请直接跳到第5步。&/p&
&p&如果对方认可抄袭行为，也愿意道歉或者赔偿，&/p&
&br&&br&&p&&strong&但是！&/strong&&/p&
&p&注意这个但是，但是&strong&【不公开】道歉，【低价】赔偿&/strong&，这就是认性不认量了，比如私下给你个人道歉，或者10元/张的价格敷衍了事，这是一个常用的把戏，我见多了，原创者往往认为，对方都道歉了，就算了吧。&/p&
&p&不能算了！这是对自己的不负责任！&/p&
&p&每一个作品都是你的孩子，抄袭行为可不就是拐卖儿童！&/p&
&p&咬咬牙，坚持。&/p&
&p&告诉对方，&/p&
&p&&strong&我不同意！&/strong&&/p&
&br&&br&&p&&strong&4.&/strong&&strong&协商不成法律言&/strong&&/p&
&br&&br&&p&假如对方同意了你的请求，那最好了，如果不同意，你要继续拿出法律武器，说：&strong&【如果协商失败，将走法律程序】&/strong&&/p&
&p&我为什么告诉你这么多次，要讲法用法，因为假如真的到了法庭上，你是必赢的。&/p&
&p&虽然你可能看了很多不公正的司法案例，但是请相信我，明显对错的案件是不会颠倒黑白的，我们的法律是可以被信任的。&/p&
&p&一般而言，到这里对方就会缴械投降了。&/p&
&p&但是，也有例外。&/p&&br&&p&&strong&5&/strong&&strong&、声讨檄文要果断&/strong&&/p&&br&&p&我要说说2015年的王源宗被cctv盗用的事情，他在微博与微信里发布的声讨檄文十分火爆，有句话说得好，“在互联网时代，发微博比找警察管用”，说的就是这个道理。&/p&
&p&但讨檄文，不是随便写的。&/p&
&p&如果你蹭不上CCTV的大IP，那么你需要一些写作技巧了。&/p&
&p&在新媒体时代，一篇推送是否为好推送，能否带来关注度，重点在于【共鸣】，即能否引发共鸣，所以这类文章最难地方在于，你讲了半天你的故事你有多悲惨但是没有人感兴趣啊！&/p&
&p&我是看过这类文章的，对话截图堆满屏，让人无心阅读。&/p&

&p&俗话说，防患于未然，能防止被抄袭就不要抄袭后去维权。&/p&

&p&这句话看似和现状&strong&相悖&/strong&，互联网自媒体领域未经许可就大肆转载情况泛滥，尤其是一些靠抄袭增粉的营销号，但如果不是真的想把商业模式做大，获得别人的授权后才能转载肯定是必须的，只要原创者没有写【欢迎转载】，其他情况下，未经允许转载其实都面临被维权的&strong&风险&/strong&。&/p&
